Fisheries (Cost Recovery) Amendment Rules 2024

Present:
Her Excellency the Governor-General in Council
These rules are made under section 263 of the Fisheries Act 1996—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister for Oceans and Fisheries made after complying with subsection (4) of that section.
Rules
1 Title
These rules are the Fisheries (Cost Recovery) Amendment Rules 2024.
2 Commencement
These rules come into force on 2 December 2024.
3 Principal rules
These rules amend the Fisheries (Cost Recovery) Rules 2001.
4 Schedule 1 amended
(1)
In Schedule 1, in the Part 1 heading, replace “and 2024/2025”
with “, 2024/2025, and 2025/2026”
.
(2)
In Schedule 1, clause 1, definition of fishing year, after paragraph (b), insert:

the 2025/2026 fishing year
(3)
In Schedule 1, in the heading to clause 2, replace “and 2024/2025”

Explanatory note
This note is not part of the rules but is intended to indicate their general effect.
These rules, which come into force on 2 December 2024, amend the Fisheries (Cost Recovery) Rules 2001 (the principal rules).
Schedule 1 of the principal rules allows 100% of the costs of installing and maintaining on-board cameras and other equipment to be recovered from quota owners for a transitional period, which includes the 2023/2024 and 2024/2025 fishing years. These amendment rules extend the transitional regime by adding the 2025/2026 fishing year.
