These regulations are administered by the Ministry for Primary Industries.

These regulations are made under sections 117, 118, and 166 of the Animal Products Act 1999—

(a)

on the advice and with the consent of the Executive Council; and

(b)

on the recommendation of the Minister for Food Safety made after being satisfied that the requirements of sections 113 and 115 of that Act have been met.

Regulations

1 Title

These regulations are the Animal Products (Fees, Charges, and Levies) Amendment Regulations 2025.

2 Commencement

(1)

These regulations come into force on 1 July 2025.

(2)

However,—

(a)

regulation 6(1) comes into force on 1 July 2026; and

(b)

regulation 6(2) comes into force on 1 July 2027.

Part 6 Charges for use of electronic certification system

For industry users that access the Ministry’s electronic certification system, charges based on the following formula are payable in respect of each request:

cost per request × appropriate percentage

where—

cost per request: is the amount for each request, specified from time to time by the Director-General by notice under section 167(1) of the Act for the purpose of section 117(4A) of the Act and having regard to clause 2
appropriate percentage: is,—

(a)

for industry users of a class for which recognised agency use of the electronic certification system is not required, 55%:

(b)

for other industry users, 100%.

In setting any cost per request, the aim is for these costs to reflect usage of the electronic certification system for the relevant year or other period, with regular updating if appropriate.

This Part applies to all users of the electronic certification system.

Explanatory note

This note is not part of the regulations but is intended to indicate their general effect.

These regulations amend the Animal Products (Fees, Charges, and Levies) Regulations 2007 (the principal regulations). They come into force on 1 July 2025, except for regulation 6(1), which comes into force on 1 July 2026, and regulation 6(2), which comes into force on 1 July 2027.

The principal regulations set out fees and charges for the performance or exercise of certain functions, powers, and duties undertaken by, or on behalf of, the Ministry for Primary Industries (the Ministry) under the Animal Products Act 1999 (the Act) and associated secondary legislation (other than fees and charges payable by dairy processors for dairy processing operations or premises). These regulations amend the rates at which the Ministry recovers costs from the animal products industry for a range of services the Ministry provides.

These amendment regulations—

adjust fees and charges relating to the issue of official assurances under section 61 of the Act (regulation 4(1)):
adjust charges relating to Ministry verification activities and rates for Ministry employees and recognised persons engaged by the Ministry in respect of work relating to live animals or germplasm (regulation 4(3) and (5)). Shift rates and breakfast shift charges remain unchanged for Ministry verification activities:
adjust the minimum call-out charges for Ministry employees and recognised persons engaged by the Ministry in respect of assessments relating to the export of live animals and animal germplasm (regulation 4(7)). The call-out rates for after-hours call-outs remain unchanged:
adjust the formula for calculating charges associated with using the Ministry’s electronic certification system (regulation 4(4)):
clarify that the fee for failing to attend a scheduled booking with a veterinarian applies to bookings with a recognised person, and move that fee to Part 8 of Schedule 1 to better reflect that the booking relates to the export of live animals and animal germplasm (regulation 4(2) and (9)):
revoke the minimum call-out charge for after-hours call-outs on public holidays and Ministry holidays for verifiers, and for recognised persons carrying out activities relating to the export of live animals and animal germplasm (regulation 4(6) and (8)):
adjust levies for operators that process lambs, bobby calves, sheep, and cattle wholly or partly for export (regulation 5(1)):
adjust the annual levy for homekill and recreational catch service providers by annual increases of 2% for the next 3 years (regulations 5(2) and 6).

These regulations must be confirmed by an Act before the close of 30 June 2026. If they are not confirmed, they will be revoked on the close of that date. See subpart 3 of Part 5 of the Legislation Act 2019.
