These regulations are made under section 82A(1) of the Administration Act 1969 on the advice and with the consent of the Executive Council.

Regulations
1 Title
These regulations are the Administration (Prescribed Amounts) Amendment Regulations 2025.
2 Commencement
These regulations come into force on 24 September 2025.
3 Principal regulations
These regulations amend the Administration (Prescribed Amounts) Regulations 2009.
4 Regulation 4 amended (Prescribed amount for purposes of sections 64, 64A, and 65 of Act)

In the heading to regulation 4, replace “64, 64A, and 65”
with “64(1) and 64A(3)”

Revoke regulation 4(c) and (d).
5 New regulation 4A inserted (Prescribed amount for purposes of section 65(2) and (5) of Act)
After regulation 4, insert:
4A Prescribed amount for purposes of section 65(2) and (5) of Act
For the purposes of section 65(2) and (5) of the Act, the prescribed amount is $40,000.

Explanatory note
This note is not part of the regulations but is intended to indicate their general effect.
These regulations, which come into force on 24 September 2025, amend the Administration (Prescribed Amounts) Regulations 2009 (the principal regulations). Section 65(2) of the Administration Act 1969 (the Act) provides that certain entities (for example, superannuation funds and banks) may pay money from a deceased person’s estate to certain relatives without grants of administration if the amount does not exceed a prescribed amount. Section 65(5) of the Act provides that insurers may pay money to a deceased person’s estate without grants of administration if the amount does not exceed a prescribed amount. The prescribed amounts are set in the principal regulations. The amendments increase the prescribed amount, in each case, from $15,000 to $40,000.
