These regulations are made under section 163 of the Climate Change Response Act 2002—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister of Climate Change made after—
(i)
complying with sections 3A and 3B of that Act; and
(ii)
having regard to the matters referred to in section 163(5) of that Act.

Regulations
1 Title
These regulations are the Climate Change (Stationary Energy and Industrial Processes) Amendment Regulations 2025.
2 Commencement
These regulations come into force on 1 January 2026.
3 Principal regulations
These regulations amend the Climate Change (Stationary Energy and Industrial Processes) Regulations 2009.
4 Regulation 16 amended (Collection and recording of information for purpose of calculating emissions from natural gas mined other than for export)
After regulation 16(4), insert:
(4A)
If the person complies with subclause (3)(a) by sampling the natural gas downstream of processing it, the information that they are required to collect and record in relation to the gas from the field concerned includes the total number of tonnes of carbon dioxide that is—
(a)
removed in that processing, whether or not in the year; and
(b)
sold by the person in the year (including for export), as measured at the point of sale.
(4B)
In subclause (4A), the point of sale is the point at which the sale of the carbon dioxide is deemed to have occurred in accordance with generally accepted accounting practice.
5 Regulation 17 amended (Method of calculating emissions from natural gas mined other than for export)

is the total number of tonnes of carbon dioxide that is removed in processing natural gas from the field, whether or not in the year, and sold by the person in the year (including for export), as recorded under regulation 16(4A).
6 Regulation 50 amended (Method of calculating emissions in relation to purchasing natural gas)

Explanatory note
This note is not part of the regulations but is intended to indicate their general effect.
These regulations, which come into force on 1 January 2026, amend the Climate Change (Stationary Energy and Industrial Processes) Regulations 2009.
The amendments—
require a person who is a participant in the New Zealand greenhouse gas scheme because they mine natural gas, other than for export, to collect and record information about carbon dioxide that they remove in processing the natural gas and sell (if certain circumstances apply); and
make a related change to a formula dealing with the calculation of emissions from natural gas mined other than for export; and
update the default emissions factors for geothermal fluid that is used for the purpose of generating electricity or industrial heat; and
update the default emissions factors for mining, or purchasing natural gas mined, at listed natural gas fields and add 1 new field to the list.
