Regulations

1 Title

These regulations are the Climate Change (Eligible Industrial Activities) Amendment Regulations 2025.

2 Commencement

These regulations come into force on 17 April 2025.

3 Principal regulations

These regulations amend the Climate Change (Eligible Industrial Activities) Regulations 2010.

4 Regulation 7 amended (Aluminium smelting)

Replace regulation 7(4)(o) and (p) with:

2.9353, which is the allocative baseline for any 2024 final allocation:

4.0818, which is the allocative baseline for any 2025 provisional allocation:

(q)

4.0818, which is the allocative baseline for any 2026 provisional allocation.

5 Regulation 23 amended (Manufacture of iron and steel from iron sand)

After regulation 23(3), insert:

Despite anything in these regulations, the allocative baselines for Products A to E that are produced by New Zealand Steel Limited (company number 68953) are as follows:

(a)

for Product A,—

(i)

2.8574, which is the allocative baseline for any 2024 final allocation:

(ii)

2.8574, which is the allocative baseline for any 2025 provisional allocation:

(iii)

2.8574, which is the allocative baseline for any 2026 provisional allocation:

for Product B,—

Explanatory note

This note is not part of the regulations but is intended to indicate their general effect.

These regulations amend the Climate Change (Eligible Industrial Activities) Regulations 2010 and come into force on 17 April 2025.

For products that New Zealand Aluminium Smelters Limited produces by aluminium smelting, the amendments—

replace the 2024 provisional allocative baseline with a final allocative baseline; and
replace the 2025 provisional allocative baseline; and
provide a 2026 provisional allocative baseline.

For products that New Zealand Steel Limited produces by the manufacture of iron and steel from iron sand, the amendments provide—

the 2024 final allocative baseline; and
a 2025 provisional allocative baseline; and
a 2026 provisional allocative baseline.
