Order

1 Title

This order is the Public Service (Chief Executive for Digital Government) Order 2026.

2 Commencement

(1)

This order comes into force on 30 July 2026.

(2)

However, clause 5(2) comes into force on 30 July 2031.

3 Principal Act

Clause 5 amends the Public Service Act 2020.

4 Functional chief executive role of Chief Executive for Digital Government

For the purposes of section 51(4)(a) to (d) of the Public Service Act 2020,—

(a)

the designation of the functional chief executive role to which this order relates is Chief Executive for Digital Government; and

(b)

the department that will be the host department for that role is the Public Service Commission; and

(c)

the particular function of the role to be carried out within the host department is leading the Government’s digital modernisation strategy, digital service delivery, and related investment, including—

(i)

establishing, managing, and assuring common cross-government processes, standards, infrastructure, and services relating to digital government; and

(ii)

leading digital investment and procurement decision-making on behalf of public service agencies and Crown entities; and

(iii)

acting as the chief technology officer for the Government; and

(iv)

establishing and managing all-of-government information and communications technology common capabilities and services; and

(v)

leading and developing digital capability across the Public Service; and

(vi)

overseeing and delivering some digital system assets on behalf of agencies.

(d)

the functional chief executive role is disestablished at the close of 29 July 2031, and the item in Schedule 5 of the Public Service Act 2020 relating to the role is repealed on 30 July 2031 (see clauses 2(2) and 5(2)).

5 Schedule 5 amended

(1)

In Schedule 5, insert in its appropriate alphabetical order:

Chief Executive for Digital Government

Public Service Commission

(2)

In Schedule 5, repeal the item relating to the Chief Executive for Digital Government.

6 Revocation of this order

This order is revoked on 30 July 2031, immediately after the repeal referred to in clause 5(2).

Explanatory note

This note is not part of the order but is intended to indicate its general effect.

This order, which mostly comes into force on 30 July 2026, is made under the Public Service Act 2020 (the principal Act). The order relates to the establishment of a new functional chief executive role, designated as the Chief Executive for Digital Government, to be hosted by the Public Service Commission.

The order amends the principal Act by inserting the name of the new role and that of its host department into Schedule 5 (functional chief executives and host departments). In accordance with section 51(4) of the principal Act, the order also sets out the particular function of the role to be carried out within the host department.

The Chief Executive for Digital Government role is established for a 5-year term from 30 July 2026. Clause 5(2) of the order, which comes into force on 30 July 2031, provides for Schedule 5 to be further amended to repeal the item related to the role on that date.

This order is itself revoked on 30 July 2031, immediately after the repeal of the item in Schedule 5 is effected.
