Present:
Her Excellency the Governor-General in Council
These regulations are made under section 163 of the Climate Change Response Act 2002—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister of Climate Change made after—
(i)
complying with sections 3A and 3B of that Act; and
(ii)
having regard to the matters referred to in section 163(5) of that Act.

Regulations
1 Title
These regulations are the Climate Change (Stationary Energy and Industrial Processes) Amendment Regulations 2026.
2 Commencement
These regulations come into force on 9 July 2026.
3 Principal regulations
These regulations amend the Climate Change (Stationary Energy and Industrial Processes) Regulations 2009.
4 New regulation 4A inserted (Transitional, savings, and related provisions)
After regulation 4, insert:
4A Transitional, savings, and related provisions
The transitional, savings, and related provisions set out in Schedule 1AA have effect according to their terms.
5 Regulation 50 amended (Method of calculating emissions in relation to purchasing natural gas)
In regulation 50(7), formula, item EFavge, replace “59.03”
with “53.71”
.
6 New Schedule 1AA inserted
Insert the Schedule 1AA set out in the Schedule of these regulations as the first schedule to appear after the last regulation of the principal regulations.

1 Application of regulation 5 of Climate Change (Stationary Energy and Industrial Processes) Amendment Regulations 2026
Regulation 5 of the Climate Change (Stationary Energy and Industrial Processes) Amendment Regulations 2026 applies from the commencement of 2026.
Guidance note
Regulation 5 of the Climate Change (Stationary Energy and Industrial Processes) Amendment Regulations 2026 amends item EFavge (the national average emissions factor for natural gas) of the formula in regulation 50(7) of these regulations.

Explanatory note
This note is not part of the regulations but is intended to indicate their general effect.
These regulations, which come into force on 9 July 2026, amend the Climate Change (Stationary Energy and Industrial Processes) Regulations 2009 (the principal regulations).
The amendment in regulation 5 applies from 1 January 2026. It amends regulation 50(7) of the principal regulations to update the national average emissions factor for natural gas in the formula for calculating total emissions from the activity of purchasing natural gas.
Date of notification in Gazette: 9 April 2026.
These regulations are administered by the Ministry for the Environment.
