Explanatory note

This note is not part of the regulations but is intended to indicate their general effect.

These regulations, which come into force on 1 July 2026, amend the Court of Appeal Fees Regulations 2001 to increase the fees payable in respect of civil proceedings in the Court of Appeal. The fees include goods and services tax.

The fees are being increased by an inflation adjustment of 2.25%, which is based on a weighted average of the Labour Cost Index and the Producers Price Index. The new fees are rounded to the nearest dollar.

These regulations also replace references to the Court of Appeal (Access to Court Documents) Rules 2009 with references to corresponding provisions of the Senior Courts (Access to Court Documents) Rules 2017.
