Ngati Tuwharetoa, Raukawa, and Te Arawa River Iwi Waikato River Bill

Proposed amendments

Hon Christopher Finlayson, in Committee, to move the following amendments:

New clause 8A

Insert the following clause on page 12 after line 2:

8A Relationship with Waikato-Tainui Raupatu Claims (Waikato River) Settlement Act 2010

  • The matters provided for in sections 9 to 34 are also provided for in sections 9 to 34 of the Waikato-Tainui Raupatu Claims (Waikato River) Settlement Act 2010, having been agreed between the Crown and Waikato-Tainui in a deed of settlement dated 17 December 2009.

Clause 38(1)

Omit.

Clause 38(2)(a)

Insert after “plan” (page 28, line 24) “, and the Trust for Ngati Tuwharetoa if it did not participate in the preparation of the plan and decides under clause 4(4A) of Schedule 5 to participate in the review,”.

Clause 46(2)(a)(i)

Omit “; and” (page 33, line 21) and substitute “:”.

Clause 57(3)

Omit “settlement” (page 45, line 1) and substitute “operational”.

Schedule 4: clause 2(3)(b)

Omit “the settlement” (page 66, line 12) and substitute “this Act”.

Schedule 4: clause 2(5)(b)(ii)

Omit “the settlement” (page 66, line 30) and substitute “this Act”.

Schedule 4: clause 2(6)(b)(ii)

Omit “the settlement” (page 67, line 5) and substitute “this Act”.

Schedule 5: clause 4(1)

Omit the subclause (page 79, lines 28 to 31).

Schedule 5: new clause 4(4A)

Insert the following subclause on page 80 after line 13:

  • (4A) If the Trust for Ngati Tuwharetoa did not participate in the preparation of the plan, the following provisions apply:

    • (a) the other Trusts must give the Trust for Ngati Tuwharetoa written or electronic notice of an intended review under subclause (2) or (4):

    • (b) if the Trust for Ngati Tuwharetoa decides to participate in the review, it must give the other Trusts written or electronic notice of its decision within 30 business days after receipt of the other Trusts' notice:

    • (c) if the Trust for Ngati Tuwharetoa decides not to participate in the review, it must give the other Trusts written or electronic notice of its decision—

      • (i) as soon as practicable after the decision is made; and

      • (ii) within 30 business days after receipt of the other Trusts' notice.

Explanatory note

This Supplementary Order Paper inserts a provision stating the connection between this Bill and the Waikato-Tainui Raupatu Claims (Waikato River) Settlement Act 2010. It also corrects drafting errors.
