Smoke-free Environments (Prohibiting Smoking in Motor Vehicles Carrying Children) Amendment Bill

Proposed amendments

Hon Jenny Salesa, in Committee, to move the following amendments:

Clause 9

In clause 9, replace new section 20D(2)(b) (page 3, line 26) with:

(b)

the motor vehicle is—

(i)

manufactured for use as an occasional or permanent dwelling; and

(ii)

stationary on a road and in use as a dwelling.

In clause 9, replace new section 20E(3) (page 5, lines 1 to 3) with:

(3)

Despite subsection (1), a constable must not take either of the actions referred to in subsection (1)(c) and (d) if the motor vehicle is—

(a)

manufactured for use as an occasional or permanent dwelling; and

(b)

stationary on a road and in use as a dwelling.

Explanatory note

This Supplementary Order Paper amends the Smoke-free Environments (Prohibiting Smoking in Motor Vehicles Carrying Children) Amendment Bill to narrow the exemption for smoking in motor vehicles that are stationary on a road and in use as a dwelling.

The exemption will apply only to motor vehicles that are manufactured for use as an occasional or permanent dwelling, as well as being stationary on a road and in use as a dwelling.
