Explanatory note

This revision-tracked Supplementary Order Paper (SOP) amends the Secondary Legislation Bill (the Bill), which is a companion to the Legislation Act 2019. The amendments made by this SOP are in the following 5 broad categories:

  • commencement matters:

  • updating for 2020 Acts:

  • Schedule 3 exemptions:

  • amendments to the Legislation Act 2019:

  • other technical amendments.

Commencement matters

Some of the amendments to the Legislation Act 2019 need to be made ahead of the main commencement date to facilitate the orderly implementation of that Act (for example, to allow regulations to be made). New clause 2(1A) will therefore bring the amendments to that Act, and most of the amendments to the related Legislation (Repeals and Amendments) Act 2019, into force on Royal assent.

As the Bill amends many thousands of provisions, it is inevitable that some of the amendments will have been overtaken by other Acts that amend or repeal the same provisions before this Bill comes into force. When Schedules 1 to 32 are commenced, those amendments will be excluded and left uncommenced. To prevent them later from coming into force on the back-stop date, new clause 2(1B)(a) will repeal them on that date.

The final stage of implementation of the Legislation Act 2019 requires various provisions of that Act, the Legislation (Repeals and Amendments) Act 2019, and the Bill to come into force at the same time. Therefore, the back-stop dates for their commencements need to be aligned. The commencement provisions of those 2 Acts are therefore amended to align with the Bill.

Updating for 2020 Acts

The main thing the Bill does is amend each provision in the statute book that empowers the making of instruments with legislative effect to state that those instruments are secondary legislation. As introduced, the Bill contained amendments to the statute book as it stood at 1 June 2019.

At select committee stage, amendments were included to make equivalent changes in relation to empowering provisions enacted between 1 June 2019 and 31 December 2019. This SOP now makes equivalent changes in relation to empowering provisions enacted by the Acts enacted between 1 January 2020 and 6 September 2020 (when Parliament was dissolved for the election).

The changes include inserting new Schedule 24A for the renamed Public Service Commission, removing Schedule 28 (for the former State Services Commission), and removing the amendments to Acts that have been repealed.

It is not yet known whether some amending Acts enacted in 2020 will commence before or after the Bill. To allow for this, the Bill includes amendments to the amending Acts and, if those Acts commence before the Bill, new clause 3(5) of the Bill will cause those amendments to take effect.

Schedule 3 exemptions

Conditions

Under the Legislation Act 2019, secondary legislation may be exempted from the usual requirements for presentation, disallowance, and publication. The empowering provisions to which those exemptions apply are listed in new Schedule 3 of that Act, which will be inserted at different stages by Schedules 35 and 36 of the Bill.

For some provisions, the exemption only applies if stated criteria are met (for example, if the secondary legislation relates to matters of national security). For a subset of those provisions, there is an additional requirement that if secondary legislation is not published in reliance on the exemption, it must instead be given to the persons to whom it applies.

Currently, the Bill deals with those additional requirements in different ways for different Acts. It would clearly be preferable for this issue to be dealt with in the same way for all Acts. It is considered that the best approach is to have the alternative notification requirements in the relevant Act with the empowering provision under which the secondary legislation is made.

The Bill is therefore amended to remove the conditions from new Schedule 3 of the Legislation Act 2019 and to insert or amend provisions in each affected Act (the Animal Products Act 1999, Biosecurity Act 1993, Civil Aviation Act 1990, and Wine Act 2003) to require exempt secondary legislation to be given or made available to the persons to whom it applies.

International Terrorism (Emergency Powers) Act 1987

The Bill as introduced provided publication, list, and presentation exemptions for instruments made under section 14 or 15 of the International Terrorism (Emergency Powers) Act 1987. Following questions from the select committee, the interested agencies have reconsidered the need for these exemptions and concluded that they are not necessary. Schedule 36 of the Bill is therefore amended to remove them.

Exemption from presentation of secondary legislation made by the House

The Bill is amended to include presentation exemptions for secondary legislation made by resolution of the House under the COVID-19 Public Health Response Act 2020, the Epidemic Preparedness Act 2006, and the Tariff Act 1988. Under the Legislation Act 2019, secondary legislation will be required to be presented to the House by default. However, that is unnecessary in the case of secondary legislation that the House itself has made.

Amendments to Legislation Act 2019 (Schedules 33 to 36)

Amendments to sections 74 and 147

The Legislation Act 2019 currently provides that the current publication requirements for secondary legislation made under existing empowering provisions will be preserved and publication requirements for secondary legislation made under new empowering provisions (ie, ones enacted after the Legislation Act 2019 comes into force) will be set in regulations.

This provides limited flexibility and in some circumstances could cause difficulties for makers, and confusion for the public, with secondary legislation made under different provisions of the same Act being published in different ways. To provide flexibility to deal with these situations, sections 74 and 147 are amended so that the maker of secondary legislation under an existing empowering provision can “opt in” to the publication requirements prescribed in regulations, so that they apply instead of the old “saved” requirements.

New section 79A

As part of the transitional arrangements in the Legislation Act 2019, the Parliamentary Counsel Office will be recording publication information for the purposes of section 74 of that Act. New section 79A is inserted to make it clear that the publication information is not part of the law.

Schedule 1, clause 32

Clause 32 of Schedule 1 of the Legislation Act 2019 makes transitional arrangements for the application of the Legislation Act 2019’s presentation requirements. This clause is amended to ensure that all secondary legislation made under an empowering provision enacted after the Legislation Act 2019 comes into force will be required to be presented to the House, and generally to simplify the provision.

Schedule 4

Schedule 4, which lists the empowering provisions for secondary legislation that is required to be confirmed, is amended to add 2 empowering provisions.

  • Amendments made by the Land Transport (Rail) Legislation Act 2020 resulted in certain regulations made under section 167(1)(j) of the Land Transport Act 1998 becoming confirmable instruments for the purposes of the Legislation Act 2012. That provision is added to Schedule 4 of the Legislation Act 2019 so that the confirmation requirement will continue.

  • New section 63ZZI of the Forests Act 1949 (which will be inserted by section 7 of the Forests (Regulation of Log Traders and Forestry Advisers) Amendment Act 2020) allows for confirmable regulations to be made, so that section is added to Schedule 4.

Other technical amendments

This SOP also makes other technical amendments, including—

  • to insert amendments to empowering provisions that were previously overlooked, including to capture some powers of subdelegation that had not previously been identified:

  • to correct amendments to empowering provisions that inadvertently catch as secondary legislation instruments that do not have legislative effect, for example,—

    • where some, but not all, instruments made under a provision have legislative effect and the amendments currently in the Bill misdescribe the non-legislative instruments:

    • where 2 different kinds of instruments may be made under the same provision, only 1 kind has legislative effect, and the amendments currently in the Bill inadvertently cover all instruments made under the provision:

  • to correct amendments that would otherwise change the publication, presentation, or disallowance status of instruments when that is not intended:

  • to correct amendments to ensure that empowering provisions and related procedural provisions will integrate correctly with the Legislation Act 2019:

  • to correct typographical or grammatical errors, incorrect codes, and other similar errors.

The Parliament of New Zealand enacts as follows:

1 Title

This Act is the Secondary Legislation Act 2019.

2 Commencement

(1)

This Act comes into force

(a)

on 1 or more dates set by Order in Council; or

(b)

to the extent not brought into force earlier, on the fifth anniversary of the date of Royal assent.

This Act comes into force on 1 or more dates set by Order in Council, unless this section provides otherwise.

(1A)

Section 4 and Schedules 33, 34, and 35 (amendments to Legislation Act 2019) and section 6 (amendments to Legislation (Repeals and Amendments) Act 2019) come into force on the day after the date of Royal assent.

(1B)

If any provision of this Act has not come into force before the fifth anniversary of the date of Royal assent,

(a)

in the case of an item, or any part of an item, in any of Schedules 1 to 32, it is repealed on that fifth anniversary without coming into force; or

(b)

otherwise, it comes into force on that fifth anniversary.

(2)

One or more Orders in Council may set different dates for different provisions (and, for that purpose, may commence a provision only for the purpose of giving effect to some, but not other, parts of this Act).

(3)

An Order in Council under this section is secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).

3 Amendments to Acts as set out by administering agency in Schedules 1 to 32

(1)

Amend the Acts set out in the tables in Schedules 1 to 32 of this Act, in each case,—

(a)

at the location specified in the first column of the table; and

(b)

in the manner specified in the second column of the table.

(2)

Subsection (3) applies where an amendment in the second column of a table in Schedules 1 to 32 has the effect of inserting text that includes the placeholder “[standard text]”.

(3)

For each placeholder, substitute “secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements)”.
