Commerce Amendment Bill

Proposed amendments

Hon Dr David Clark, in Committee, to move the following amendments:

Clause 4(14)

Replace clause 4(14) (page 5, lines 15 and 16) with:

In section 2(8)(a),—

(a)

after “understanding arrived at”, insert “, or covenant given or required to be given,”; and

(b)

replace “or arrived at” with “, arrived at, given, or required to be given”.

Clause 19

In clause 19, new section 58(6B), replace “, or might contain” (page 10, line 6) with “a provision that is, or might be”.

In clause 19, new section 58(6C), replace “, or might contain” (page 10, lines 10 and 11) with “a provision that is, or might be”.

Clause 32

In clause 32, cross-heading above new section 99AA, replace and Reserve Bank (page 17, line 2) with Reserve Bank, and New Zealand Police.

In clause 32, heading to new section 99AA, replace and Reserve Bank (page 17, line 4) with Reserve Bank, and New Zealand Police.

Explanatory note

This Supplementary Order Paper proposes amendments to the Commerce Amendment Bill. The amendments to clause 32, new sections 99AA and 99AB,—

  • bring the New Zealand Police within the list of agencies to whom the Commerce Commission may provide information or copies of documents if the Commission considers the information or documents may assist an agency in performing or exercising the agency’s functions, powers, or duties under legislation, and on whom the Commission may impose conditions when providing information or documents (for example, conditions to protect privacy); and

  • allow the Commission, in performing or exercising its functions, powers, or duties, to use information or documents provided to it by the New Zealand Police under legislation.

The amendments to clauses 4 and 19 are technical amendments.

Departmental disclosure statement

The Ministry of Business, Innovation, and Employment is required to prepare a disclosure statement to assist with the scrutiny of this Supplementary Order Paper. The disclosure statement provides access to information about any material policy changes to the Bill and identifies any new significant or unusual legislative features of the Bill as amended.
