Clause 167B

After clause 167B(b) (page 108, after line 11), insert:


within 6 months after the date on which the regulator announces a decision not to prosecute:

Explanatory note

This Supplementary Order Paper amends clause 167B of the Health and Safety Reform Bill to ensure the protection of health and safety in New Zealand is not weakened by it.

Clause 167B allows private prosecutions within 2 years of the issue becoming known to the regulator. However if the regulator has not determined whether to prosecute within 2 years this could mean this time runs out through no fault of the person wishing to bring a private prosecution. This amendment will correct this to allow a private prosecution to be brought if it is within 6 months of the regulator announcing a decision not to prosecute.
