Social Security (Commencement of Benefits) Amendment Bill

Jan Logie, in Committee, to move the following amendment:

Clause 2

In clause 2, after “on the day” (page 1, line 6), insert “that is 6 months”.

Explanatory note

This Supplementary Order Paper amends clause 2, delaying the commencement date by 6 months to give people more of a chance to apply for their benefits to be back-paid as is their right by law.

There has been no formal way to apply to receive the balance of the miscalculation of benefits, and there have not been many applications for a review of decision. This would indicate the need for time to apply.

Prior to this Bill being before the House, members of the public may not have been aware of this issue or their entitlement. Delaying the commencement of this Bill by 6 months will provide those affected adequate time to consider applying for a review. Delaying commencement by 6 months takes the time beyond the end of year and holiday period and is judged to be a minimum time frame to notify people.
