Proposed amendments

David Seymour, in Committee, to move the following amendments:

New clause 18A

After clause 18 (page 10, after line 26), insert:

18A Complaints about enforcement officers


Any person may complain to the Director-General about the conduct of an enforcement officer (other than a constable) in exercising any of the powers conferred by or under this Act.


After receiving a complaint, the Director-General must investigate the complaint as soon as practicable.

Clause 19

Replace the heading to clause 19 (page 10, line 27) with Evidence of identity and right to complain

In clause 19(b) replace “ .” (page 10, line 32) with “; and”.

After clause 19(b) (page 10, after line 32), insert:


a written statement setting out a person’s rights under the New Zealand Bill of Rights Act 1990 and the right to make a complaint to the Director-General under section 18A.

Explanatory note

This Supplementary Order Paper amends the Bill to require enforcement officers to notify persons of their existing legal rights and the right to complain to the Director-General. It also inserts a new duty of the Director-General to investigate a complaint against an enforcement office.
