Proposed amendment
Hon Nick Smith, in Committee, to move the following amendment:
New clause 106A
After clause 106 (page 49, after line 29), insert:
106A Reorganisation orders must be approved by House of Representatives
(1)
This section applies to Orders in Council made under the following sections:
(a)
section 21 (which relates to the establishment and reorganisation of departments and departmental agencies):
(b)
section 24 (which relates to the establishment and reorganisation of interdepartmental executive boards):
(c)
section 31 (which relates to the establishment and reorganisation of interdepartmental ventures):
(d)
section 106 (which relates to savings and transitional matters connected with reorganisations within public service).
(2)
An Order in Council to which this section applies does not come into force until it has been approved by a resolution of the House of Representatives.
(3)
An Order in Council to which this section applies is revoked if—
(a)
a motion to approve the Order in Council is defeated; or
(b)
no motion to approve the Order in Council is agreed to within the relevant period.
(4)
The relevant period is the longer of the following:
(a)
the period of 10 sitting days of the House of Representatives after the date on which the order is made:
(b)
the period of 60 days after the date on which the order is made.
