Clause 17

In clause 17, new section 89M, delete subsection (2) (page 20, lines 10 to 18).

In clause 17, new section 89T, delete subsection (2) (page 26, line 32 to page 27, line 3).

Explanatory note

This Supplementary Order Paper amends the Crown Minerals (Decommissioning and Other Matters) Amendment Bill to remove the trailing liability provisions. This is an unnecessary and highly unusual instrument in New Zealand law. Other provisions in the Crown Minerals Act 1991 and this Bill will ensure that decommissioning will be properly executed.

The Bill as it stands will make attracting directors unnecessarily difficult as they will be subject to perpetual liability. It also undermines the norms of civil and criminal liability, by making directors liable for decommissioning after a permit has been transferred.
