Crown Minerals (Decommissioning and Other Matters) Amendment Bill

Proposed amendment

Barbara Kuriger, in Committee, to move the following amendment:

Clause 17

In clause 17, after new section 89E(1) (page 13, after line 3), insert:


To avoid doubt, an obligation to decommission any petroleum infrastructure or well does not prevent the person obliged to decommission from leaving specific objects on site, or carrying out decommissioning in a particular way,—


with the consent of the landowner; and


if those actions are consistent with the requirements of this Act or any other relevant enactment or standard, or the requirements of a regulatory agency.

Explanatory note

This Supplementary Order Paper amends the Crown Minerals (Decommissioning and Other Matters) Amendment Bill to reinsert new section 89E(2), previously removed by the select committee, to remove the strict obligation to remove petroleum infrastructure if it could be repurposed by another permit holder.
