Sunscreen (Product Safety Standard) Bill

Proposed amendments

Todd Muller, in Committee, to move the following amendments:

Clause 3

In clause 3, definition of AS/NZS 2604:2021, replace “AS/NZS 2604:2021” (page 1, line 10) with “AS/NZS 2604:2012”, and “AS/NZS 2604:2021” (page 1, line 10) with “AS/NZS 2604:2012”.

In clause 3, definition of sunscreen product, paragraph (b)(iii), before “a skin care” (page 2, line 17), insert “a product that is represented as”.

In clause 3, definition of sunscreen product, paragraph (b)(iii), replace “AS/NZS 2604:2021” (page 2, line 17) with “AS/NZS 2604:2012”.

Clause 5

In clause 5(1), replace “AS/NZS 2604:2021” (page 3, line 8) with “AS/NZS 2604:2012”.

In clause 5(3), replace “AS/NZS 2604:2021” (page 3, line 14) with “AS/NZS 2604:2012”.

Schedule 1

In Schedule 1, clause 1, replace “AS/NZS 2604:2021” (page 4, line 7) with “AS/NZS 2604:2012”.

Explanatory note

This amendment alters the standard mandated by the bill to the 2012 standard, (AS/NZS 2604:2012) rather than the 2021 standard (AS/NZS 2604:2021). The 2021 standard is yet to come into force in Australia and would create a difficult regulation gap between New Zealand and Australia if it were to be mandated without respect to the timing of regulation in Australia. Regulation-making power is created in clause 5(3) of the bill, allowing the 2021 and any future standards to replace the 2012 standard with the appropriate timing. This amendment also alters the definition of sunscreen product to align it with the 2021 standard, broadening the definition to include a product that is represented as a skin care within the product standard.
