Severe Weather Emergency Recovery Legislation Bill

Proposed amendment

Simon Court, in Committee, to move the following amendment:

New clause 7A

After clause 7 (page 8, after line 5), insert:

Compensation in respect of private property

7A Part 5 of the Public Works Act 1981 to apply

Part 5 of the Public Works Act 1981 applies in respect of any act or omission done under this Act, as if that act or omission were done under the Public Works Act 1981.

Explanatory note

The Severe Weather Emergency Recovery Legislation Bill is potentially without limit, including its ability to take or damage private property without notice or compensation. This Supplementary Order Paper ensures that, if any private property is taken or damaged under this legislation, the existing provisions in the Public Works Act 1981 for compensation to be paid to the land owner will be applied.
