At Wellington this 21st day of February 2011
Present:
His Excellency the Governor-General in Council
Pursuant to section 12(1)(b) of the Immigration Advisers Licensing Act 2007, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.
Regulations
1 Title
These regulations are the Immigration Advisers Licensing (Partial Removal of Exemption) Regulations 2011.
2 Commencement
These regulations come into force on the day after the date of their notification in the Gazette.
3 Section 11(h) of Immigration Advisers Licensing Act 2007 amended
Section 11(h) of the Immigration Advisers Licensing Act 2007 is amended by repealing subparagraph (ii) and substituting the following subparagraph:
“(ii) advice only in respect of applications made under the Immigration Act 2009 for a temporary entry class visa—temporary visa—student visa:”.
Michael Webster,
for Clerk of the Executive Council.
Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on the day after the date of their notification in the Gazette, substitute section 11(h)(ii) of the Immigration Advisers Licensing Act 2007, as authorised by section 12 of that Act. The effect of the amendment is to remove, in part, the exemption provided for in section 11(h), by limiting the class of applications for temporary entry class visas that a person who is offshore may provide immigration advice on to applications made in accordance with the Immigration Act 2009 for a temporary entry class visa—temporary visa—student visa.
Issued under the authority of the Acts and Regulations Publication Act 1989.
Date of notification in Gazette: 24 February 2011.
These regulations are administered by the Department of Labour.
