Proposed amendments
Chris Hipkins, in Committee, to move the following amendments:
Clause 31, new section 158X
In clause 31 replace new section 158X (lines 15 to 20 on page 40) with:
“158X Ombudsmen Act 1975 and Official Information Act 1982 to apply to partnership schools kura hourua
The Ombudsmen Act 1975 and the Official Information Act 1982 apply to a sponsor of a partnership school kura hourua when the sponsor is performing functions under this Act or a partnership school contract.”
Clause 43
Replace clause 43(2) and (3) (lines 17 to 28 on page 45) with:
“(2) In Schedule 1, Part 2, insert the following in its appropriate alphabetical order: “Sponsors (within the meaning of section 2(1) of the Education Act 1989)”.”
Explanatory note
This Supplementary Order Paper amends the Education Amendment Bill, which as currently drafted excludes partnership schools kura hourua from the Official Information Act 1982 and restricts the Ombudsmen Act 1975’s application to the schools.
As noted by submitters on the bill, this would limit accountability, scrutiny and oversight, and partnership schools kura hourua would not be subject to the same level of public scrutiny as existing state schools.
This Supplementary Order Paper amends the bill to ensure that partnership schools kura hourua would be subject to the Official Information Act 1982 and the Ombudsmen Act 1975.
