This Act is the Real Estate Agents Amendment Act 2005.

In this Act, the Real Estate Agents Act 1976 is called “the principal Act”.

This Act comes into force on 26 April 2005.

The amendments to section 63 of the principal Act in section 4 apply only to an agreement to sell or lease any land or business that was entered into on or after the commencement of this Act.

Subsection (1) applies whether the agreement is conditional or unconditional, and regardless of the date on which, according to the agreement, the purchaser or lessor is to take possession of the land or business.

The amendment to section 82 of the principal Act in section 5 applies only in respect of any theft of a kind referred to in section 82(6) of the principal Act that occurred on or after the commencement of this Act.

Section 63(1)(b) of the principal Act is amended by inserting, after the word “spouse”, the words “, civil union partner, de facto partner,”.

Section 63(2)(b) of the principal Act is amended by inserting, after the word “spouse”, the words “, civil union partner, de facto partner,”.

Section 82(6) of the principal Act is amended by inserting, after the word “spouse”, the words “, civil union partner, or de facto partner”.
