These regulations are made under section 161A(1) of the Climate Change Response Act 2002—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister of Climate Change made after being notified as referred to in section 161A(4A).
Regulations
1 Title
These regulations are the Climate Change (Eligible Industrial Activities) Amendment Regulations (No 2) 2025.
2 Commencement
These regulations come into force on 1 January 2026.
3 Principal regulations
These regulations amend the Climate Change (Eligible Industrial Activities) Regulations 2010.
4 Regulation 6 amended (Allocation factors for electricity)
In regulation 6(a), replace “0.554”
with “0.516”
.
5 Regulation 19 amended (Manufacture of carbon steel from cold ferrous feed)

In regulation 19(2)(a), replace “product A, which consists”
with “product A and product AA, which consist”

After regulation 19(2), insert:
(2A)
An eligible person who, in a year, produces the continuously cast products and ingots of carbon steel referred to in subclause (2)(a) must use the following methodology for calculating the total amount of product A and the total amount of product AA produced in the year:
Step 1: calculate total amount of products A and AA (TA & AA)
(a)
in accordance with regulation 5, calculate the total amount (in tonnes) of those continuously cast products and ingots of carbon steel produced in the year:
Step 2: calculate total amount of cold and molten ferrous feed used (TC & M)
(b)
calculate the total amount (in tonnes) of cold ferrous feed and molten ferrous feed used to produce those continuously cast products and ingots of carbon steel in the year:
Step 3: calculate total amount of each product
(c)
use the following formula to calculate the total amount of product A produced in the year:
TA = TA & AA × (C÷ TC & M)
where—
- TA
is the total amount of product A produced in the year
- TA & AA
is the amount calculated in respect of the year at step 1
- C
is the total amount (in tonnes) of cold ferrous feed used to produce the continuously cast products and ingots of carbon steel referred to in subclause (2)(a) in the year
- TC & M
is the amount calculated in respect of the year at step 2:
(d)
use the following formula to calculate the total amount of product AA produced in the year:
TAA = TA & AA × (M ÷ TC & M)
where—
- TAA
is the total amount of product AA produced in the year
- TA & AA
is the amount calculated in respect of the year at step 1
- M
is the total amount (in tonnes) of molten ferrous feed used to produce the continuously cast products and ingots of carbon steel referred to in subclause (2)(a) in the year
- TC & M
is the amount calculated in respect of the year at step 2.
6 Schedule 1 amended
In Schedule 1,—
(a)
insert the Part set out in Schedule 1 of these regulations as the last Part; and
(b)
make all necessary consequential amendments.
7 Schedule 2 replaced
Replace Schedule 2 with the Schedule 2 set out in Schedule 2 of these regulations.

3 Allocation for period beginning 1 January 2025
These regulations, as amended by the Climate Change (Eligible Industrial Activities) Amendment Regulations (No 2) 2025, affect and are to be applied in determining the level of allocation that a person is entitled to receive for 2025, even if the person has received a provisional allocation for 2025.

Explanatory note
This note is not part of the regulations but is intended to indicate their general effect.
These regulations, which come into force on 1 January 2026, amend the Climate Change (Eligible Industrial Activities) Regulations 2010.
These regulations—
amend regulation 6 to update the electricity allocation factor, which is one of the matters used to determine the allocative baseline for products of eligible industrial activities, from 0.554 to 0.516 tonnes of CO2e per megawatt hour of electricity; and
amend regulation 19 to prescribe a new product (product AA) to be used as the basis of an allocation of New Zealand units for the eligible industrial activity of manufacturing from cold ferrous feed; and
further amend regulation 19 to prescribe a methodology for calculating the total amounts produced in a year of product AA and product A (which, without the methodology, is indistinguishable from product AA) that—
is based on the amounts of molten ferrous feed (in the case of product AA) and cold ferrous feed (in the case of product A) used in the year; and
enables different allocative baselines to be prescribed and applied in proportion to the amount of each product; and
replace Schedule 2 to update the allocative baselines for products of eligible industrial activities; and
insert a transitional provision into Schedule 1 to provide that the updated allocative baselines will apply in determining the level of allocation that a person is entitled to receive for 2025, even if they have already received a provisional allocation for 2025.
